Terms of Service

The following terms and conditions are part of each contract between MandalArt Portugal, Julia Unterberger, Rua Marquês de Pombal, 366 / Casa 9, 2755-247 Alcabideche, Portugal – hereinafter MandalArt and the customer.

1. Scope

For all mutual claims arising out of and in connection with the conclusion of a contract, these General Terms and Conditions always apply in their version valid at the time of the respective conclusion of the contract.

2. Conclusion of the contract

2.1. The presentation of the goods, especially on the Internet, does not constitute a binding offer by MandalArt.

2.2 By submitting the order, the customer makes a binding offer to purchase the goods in the shopping cart and accepts these terms and conditions. A contract is only concluded upon written confirmation of acceptance by MandalArt or by delivery of the goods by MandalArt. Such a confirmation of receipt takes place within 3 days at the latest, delivery of the goods within 14 days at the latest.

3. Privacy Policy

3.2 The personal data will no longer be used by MandalArt, unless the customer expressly agrees to the further use. The customer can query, change or delete the stored data at MandalArt at any time.

3.3. If the customer requests further information or the deletion of his data, support is available under the following e-mail address hello@mandalart.pt.

4. Terms of delivery

4.1. Delivery is ex warehouse. Europe-wide shipping costs are up to an order value of € 45.00 € 5, -, from an order value of € 45, – the delivery is free shipping. Shipping costs to other countries on request. Delivery is by post or DPD.

4.2 If MandalArt incurs additional shipping costs due to an incorrect delivery address or a wrong addressee, these costs shall be reimbursed by the customer unless he is not responsible for the misstatement.

5. Terms of payment

5.1. The purchase price is due immediately upon conclusion of the contract or the customer has to pay all amounts no later than 14 days after receiving the payment request without deduction. Alternatively, it is possible to pay by credit card or paypal during the conclusion of the contract. In the case of the existing debit order, the amount will be withdrawn from the customer account 14 days after the purchase order.

5.2. All prices are inclusive of VAT, but excluding delivery and eventual return costs.

6. Reservation of ownership

The goods remain the property of MandalArt until full payment.

7. Warranty

With regard to the warranty, the statutory provisions apply.

8. Right of withdrawal

8.1 You have the right to withdraw from this contract within fourteen days without giving any reason.

8.2 The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.

by means of a clear statement (eg a letter sent by post or e-mail) about your decision to withdraw from this contract.
In order to maintain the cancellation period, it is sufficient that you send the notice of the exercise of the right of withdrawal before the expiry of the withdrawal period.

8.3 Consequences of the cancellation

If you withdraw from this Agreement, we have selected all payments we have received from you, including delivery charges (except for the additional costs arising from your choosing a different delivery method than the most favorable standard delivery we offer have to repay immediately and no later than fourteen days from the date on which we receive the notification of your rescission of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless otherwise agreed with you; In no case will you be charged for this repayment fees.
We may refuse to repay you until we have the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

8.4 You must return the goods to us immediately and in any event not later than fourteen days from the date on which you inform us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. The customer bears the cost of returning the goods.

8.5You only have to pay for any loss of value of the goods, if this loss of value is due to a handling that is not necessary for the examination of the nature, characteristics and functioning of the goods.

8.6 Exclusion of the right of withdrawal
Goods that are personalized or customized for personal use can not be revoked.
